Welcome to Sisigestate! By accessing or using our real estate listing platform at sisigestate.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

Sisigestate is a real estate listing platform that connects property buyers, renters, sellers, and licensed real estate professionals in the Philippines.

Definitions

Eligibility

To use our Service, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding contracts under Philippine law
• Provide accurate and complete registration information
• If acting as a real estate professional, hold a valid PRC license as required under Republic Act No. 9646 (Real Estate Service Act of the Philippines)

User Accounts

When you create an account with us, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach
• Not share your account credentials or transfer your account to others

We reserve the right to suspend or terminate accounts that violate these Terms.

Property Listings

If you post property listings on our platform, you agree to:

• Provide accurate, truthful, and complete property information
• Only list properties you are legally authorized to sell, rent, or represent
• Upload photos that accurately represent the property and that you have the right to use
• Update or remove listings promptly when properties are sold, rented, or no longer available
• Disclose material defects or issues with the property
• Comply with all applicable Philippine laws regarding real estate transactions

Prohibited Activities

You may not use our Service to:

• Post false, misleading, or fraudulent property listings or information
• Impersonate another person or misrepresent your professional qualifications
• Harass, threaten, or discriminate against other users based on race, religion, gender, or national origin
• Violate any applicable Philippine laws or regulations
• Upload content that infringes on intellectual property rights
• Distribute spam, malware, or engage in phishing activities
• Scrape or harvest data from our platform without authorization
• Circumvent or disable any security features of our Service
• Engage in money laundering or use the platform for illegal financial transactions
• Post duplicate listings or artificially manipulate search results

Platform Role & Disclaimer

• We do not guarantee the accuracy, legality, or availability of any listings
• We do not verify the ownership, title, or condition of listed properties
• We are not responsible for disputes between users or transaction outcomes
• Users are strongly advised to conduct their own due diligence before entering any transaction
• We recommend engaging a licensed real estate professional and legal counsel for significant transactions

Fees and Payments

Certain features of our Service may require payment of fees. Current pricing and subscription plans are available on our website. By subscribing to paid services, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate billing information and keep it updated
• Accept that fees are non-refundable unless otherwise specified

We reserve the right to modify our fees with reasonable notice.

Intellectual Property

The Sisigestate name, logo, and platform design are our intellectual property. Content you post remains yours, but you grant us a non-exclusive, worldwide license to display and distribute it on our platform.

You may not reproduce, distribute, or create derivative works from our platform content without our written permission.

Limitation of Liability

To the maximum extent permitted by Philippine law:

• Our Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service
• Our total liability shall not exceed the amount you paid to us in the preceding 12 months
• We are not liable for any loss resulting from reliance on information provided by other users

Indemnification

You agree to indemnify and hold harmless Sisigestate, its officers, employees, and partners from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your property listings or content
• Your transactions or interactions with other users
• Your violation of any third-party rights or applicable laws

Termination

We may suspend or terminate your access to the Service at our discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us. Termination does not relieve you of any obligations incurred prior to termination.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Philippines.

Dispute Resolution

In the event of any dispute, you agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue formal legal remedies.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

Severability
